By using, installing, or accessing the Platform or Services, by signing or clicking to accept these terms or any documentation referencing these terms that are provided during the subscription process, you agree to be bound by the following terms and conditions (together, these “Terms”, or this “Agreement”). If you are using the BFN-AI service on behalf of a company, organisation, or other entity, then “Customer,” “Client,” or “you” refers to that entity, and you are binding that entity to this Agreement. You represent and warrant that you have the full legal authority to enter into this Agreement and that, if the Client is an entity, this Agreement is entered into by an employee, agent, or other representative with all necessary authority to bind that entity to this Agreement.
2. Services Overview
BFN-AI specialises in digital marketing, offering custom-built website development, targeted digital advertising strategies, and a suite of software solutions designed to meet each client's unique requirements.
3. Use of Services
3.1 Use of BFN-AI services requires a valid and active user account.
3.2 Each account is for individual use, featuring various access permissions and security settings.
4. Updates, Fixes, and Improvements
The BFN-AI platform is regularly updated with new features and improvements. These updates are automatically available to all users.
5. Customer Data
5.1 Users retain ownership of their data, which includes text, media files, and documents uploaded to the BFN-AI platform.
5.2 This data will be returned to users at the end of their subscription and then deleted from our systems.
6. Administration Data
BFN-AI stores data necessary for the administration of user accounts, including account information and security settings.
7. Use of Cookies
BFN-AI uses cookies to personalise and improve the user experience, limiting use to non-sensitive, non-personal data.
8. Ownership and Intellectual Property
8.1 All services, systems, software, and know-how utilised in BFN-AI are proprietary to Built For Now Limited.
8.2 The intellectual property is not transferred to users or customers.
9. Service Level Guarantee
We aim to maintain a service uptime of 99% annually. Should we fail to meet this level, users may be entitled to a pro-rata refund.
10. Third-Party Providers
10.1 BFN-AI integrates with third-party services and APIs, and while we strive for seamless service, we are not liable for any loss of service from these third parties.
10.2 Users consent to data sharing with these third-party services as necessary for the provision of BFN-AI services.
11. Warranty
BFN-AI services are provided "as-is". We endeavor to address any bugs or defects expeditiously.
12. Liability
BFN-AI's liability is limited to the maximum extent permitted by law and shall not be liable for any indirect losses or damages.
13. Termination
Built For Now Limited shall not be liable to the Client for any loss or damage whatsoever or howsoever caused arising directly or indirectly in connection with this Agreement, its use, or otherwise, except to the extent that such liability cannot be lawfully excluded.
Notwithstanding the generality of the foregoing, Built For Now Limited expressly excludes liability for consequential loss or damage, including but not limited to loss or damage to data or to other equipment or property (whether or not the same may be in Built For Now Limited’s care, custody, or control), or for loss of profit, business, revenue, goodwill, or anticipated savings.
In the event that any limitation or provision contained in these Terms and Conditions is held to be invalid or unenforceable for any reason and Built For Now Limited becomes liable for loss or damage that may otherwise have been excluded by this Agreement or capable of being excluded by law, such liability shall be limited to the value of one calendar month's fee paid by the Client for the service.
14. Pricing Policy
14.1 The use of BFN-AI services requires a non-refundable one-time setup fee and a monthly subscription fee.
14.2 No refunds are available for early termination.
15. Governing Law and Jurisdiction
These Terms shall be governed by the laws of England & Wales.
16. Amendments to Terms
Built For Now Limited reserves the right to amend these Terms at any time, with the amended terms becoming effective once posted or communicated to users.
17. Severability
If any part of these Terms is deemed unenforceable, the remaining portions shall remain in full effect.
